Terms and Conditions

1. Acceptance of Terms and Conditions
By placing an order with Miam, you agree to the terms and conditions as set out in this document. All terms and conditions are subject to change and update at anytime at Miam’s discretion. We encourage that you review the terms and conditions prior to placing an order.

2. Orders
Design specifications and cake flavours must be agreed upon prior to the placement of an order.
Once an order is placed, we require a 50% deposit based on the purchase price. Minor changes to the cake design will be accepted after the deposit is placed, but major changes may result in a re-quote and a AUD$50.00 administration fee. (Minor and major changes are at Miam’s discretion)

3. Payment

(i) Deposit and Remaining Balance
We require a 50% deposit based on the purchase price upon placement of an order. Orders are not confirmed until we have received the 50% deposit.
The remaining balance is due and payable at least fourteen (14) calendar days before the date of collection or delivery. Every effort will be made to send a reminder email at least seven (7) calendar days prior to this fourteen (14) calendar day period. Irrespective of whether a reminder email is sent, in the event that we do not receive the remaining balance before this fourteen (14) calendar day period, the order will be cancelled and the aforementioned deposit will be forfeited.
For orders less than AUD$100.00, payment is required in full to secure the order.

(ii) Payment Method
Payment may be made by Electronic Funds Transfer (EFT), cash or cheque only.
Full payment must be received before orders are released. We will provide written confirmation via email of the receipt of payments.

(iii) Last Minute Orders
Every effort will be made to accommodate last minute orders which are placed with less than fourteen (14) calendar days’ notice before the date of collection or delivery. We will require payment in full for all last minute orders.

4. Cancellation
All requests for cancellation must be made in writing.
If the order is cancelled more than fourteen (14) calendar days before the agreed collection or delivery date, the 50% deposit will be refunded, less a AUD$100.00 administration fee.
If the total deposit amount is less than AUD$100.00, there will be no refund of the deposit.
If the order is cancelled less than fourteen (14) calendar days before the agreed delivery or collection date, the 50% deposit will be forfeited, and there will be no refund.

5. Refund
Your happiness is our number one priority at Miam.
If you receive a cake that is damaged, we will issue you with a full refund, which means the full order price including the deposit.
Please note that once the order is in your possession, any damage to the cake will be your responsibility and Miam will not be responsible for such damage.

6. Allergy Disclaimer
Foods are manufactured in a facility whereby nuts, dairy, gluten, egg, sesame and soy are utilised, therefore, foods may contain traces of these items.

Please inform Miam of any allergies prior to placing your order. Miam will not be held responsible for any adverse reactions caused by food allergies experienced by you or your guests.
